Terms
Terms and Conditions
These terms cover use of the Cakelle Atelier website and the custom cake requests sent through it. Cakelle Atelier is located at 400 N Hogan St, Jacksonville, FL 32202, and can be reached at +1 (904) 643-4172. If a confirmed order states a more specific term, that confirmation controls the order. These terms are not a substitute for legal advice.
Custom orders
Cakelle Atelier makes cakes and cupcakes to order for celebrations. The pages on this site describe the kinds of requests the bakery invites. They are not a shelf of finished goods, and they do not lock in a design, a flavor, or a price by themselves.
A request is not an order
A form submission, an email, or a phone call is a request. An order exists only when Cakelle Atelier confirms the cake, the price, and the way it will be picked up or delivered, and you accept that confirmation. Sending a request does not reserve a date. The website has no shopping cart and does not take payment.
Pricing
Prices are quoted for the cake you described. Servings, tiers, decoration, flavor, and fulfillment can change the number. Quotes on this website are not published because a single price would not describe every cake. A quote is an offer for that request, not a standing menu.
Payment
Payment method and timing are stated in the order confirmation. This website does not process cards. No deposit amount, deposit deadline, or refund window is published here, because those rules have not been set as a site-wide policy. Do not assume a deposit is required, and do not assume a payment is refundable, until the confirmation says so. If you need those rules before you celebrate, wait for them in writing.
Cancellations and changes
There is no published cancellation period. Once an order is confirmed, any change to the date, servings, design, or fulfillment has to be accepted by the bakery. A request that was never confirmed can simply be dropped. If you need to change a confirmed order, call promptly. The confirmation, not this page, is where a cancellation or refund term will appear if one is offered.
Allergies and ingredients
You are responsible for telling us about allergies and ingredients to avoid, in the request and again if anything changes. Cakes are prepared in a bakery environment. This website does not claim an allergen-free kitchen, a gluten-free certification, or a guarantee that a cake is free of a particular ingredient unless that limit is written into the confirmation. If a safe cake cannot be promised, the bakery may decline the order.
Pickup and delivery
Pickup and delivery are available only when the confirmation says so. The business address is the address for a scheduled pickup. It is not a published walk-in counter, and opening hours are not listed. Delivery, if accepted, is discussed for Jacksonville-area addresses. Same-day delivery and mail shipping are not offered on this site. Someone should be available to receive a delivered cake. Fees, if any, are part of the quote.
Your design references
If you upload a photo or send wording, you confirm that you have the right to share it for the purpose of planning your cake. Do not send a copyrighted character, a logo, or another bakery’s design and ask for a copy. Cakelle Atelier may refuse those requests. You keep your rights in materials you created. You give the bakery permission to use them only to review and make your order.
Photographs and website content
Cake photographs on this site are style examples made for Cakelle Atelier. They are not documentation of a customer’s event. Text, layout, and images on the site belong to the business or are used with permission. Please do not copy the site or present the photographs as your own product photos.
Acceptable use
Do not misuse the form, attempt to break the site, or upload files that are not images of a cake idea. The server may reject submissions that fail the security checks.
Website availability
The site is provided as a way to learn about the bakery and to send a request. It may be unavailable during hosting or domain setup. A form error means the request was not accepted. Call the bakery if you do not see a clear confirmation that the request was sent.
Liability
To the extent the law allows, Cakelle Atelier is not liable for indirect or consequential losses arising from use of the website or from a request that was never confirmed. Nothing on this site excludes liability that cannot legally be excluded. A confirmed cake is made with ordinary care for a food order. It is still a perishable product and should be stored as the confirmation describes.
Law
These terms are governed by the laws of the State of Florida, without a special venue clause. A confirmed order may restate any dispute term that the parties actually agree. If a court finds one sentence unenforceable, the rest of the terms still apply.
Changes
These terms can be updated when the business adopts a real payment, cancellation, or delivery policy. The updated page applies to requests sent after it is published. An order already confirmed keeps the terms in that confirmation.
